Mayor’s Report: Mayor Lebold reported that he is moving from the Borough and will resign as Mayor. Mayor Lebold was asked by the Recreation Chair to contact Swarthmore Police to have a presence at the Triangle Park around 3:30 PM, when there are a lot of youths playing basketball.
Council will have to discuss, at an advertised meeting, a replacement for the Mayor position.

Building: 25 President Ave. submitted an application for an addition/dormer. Plans are needed. Completed application to be reviewed at the April 16, 2012 Building Committee Meeting.
17 President Ave., the house that burnt down, will be rebuilt. Brian Costello to address any inquiries regarding the zoning portion of the application. The homeowner and his architect will attend the April 16, 2012 Building Committee Meeting.

Communication: Marlaina Kloepfer reported that Council needs more control of email complaints. A complaint regarding property maintenance issues was sent to the Communications Committee; it should have been sent to the Borough Office/Secretary.

Public Safety: Tom Kopp reported that the Morton-Rutledge Fire Co. banquet was a success. Jack Borsch received an award for 55 years of service.

Recreation: Marie Govannicci reported that the dirt for the Triangle Park will be delivered this week or next. The port a potty has been installed. The first softball gamed will be on April 16. There will be a fundraiser for the Girls’ Club on Tuesday, March 27, at Zak’s Hamburgers. The police will patrol the Triangle Park at 3:30 PM weekdays.

Sewer: Nothing to report.

Tree Commission: Marie Govannicci spoke with Karl Eilinsfeld about plantings at the Triangle Park.

Highway: David Waltz reported that Catania Engineering completed the loan application for road repairs.

Old Business: Mayor Lebold reported that Upper Providence Twp. was notified that it would be required to pay $1,250.00/month to the Chester County SPCA until the new animal control facility is operational. Nothing has been started with the new facility.

New: The State Association of Boroughs would like the Borough to pass a resolution that supports a change in the Prevailing Wages Act. Currently, Boroughs are required to pay Philadelphia Union Wages.

The contract with Swarthmore Police expires at the end of 2012. Diane McGaughey, Tom Kopp, and Greg Lebold reviewed the current contract and suggested some changes.

Diane McGaughey attended the COG meeting on March 20, 2012. PECO, Comcast, and Verizon representatives gave presentations. PECO will install new meters in the Borough.

The Morton-Rutledge Fire Co. needs a Resolution stating that Rutledge appoints the fire company to respond to its fires and emergencies, in order to apply for grants. Morton Rutledge Fire Co. was appointed by motion in April 2010, so a Resolution is needed.
MOTION by Marie Govannicci, Second by Brian Costello, to pass Resolution 2012-03-01, a resolution that appoints the Morton-Rutledge Fire Company as the fire company to serve the Borough of Rutledge.
MOTION approved unanimously.

A request for a six-foot fence was received and referred to the Solicitor.

Daniel Werner will be the representative to CDCA until June, and then another person will be appointed.

David Waltz reported that Harry Mirra needs to go to Mr. Waltz’s three neighbors because they have cut down their bamboo, but not taken out the roots, as required by the ordinance.
The sidewalk on the Morton Ave. side of 1 Sylvan Ave. is made of bricks, and needs to be level.

Tax Collector’s Report: Thomas Heron stated that he filed a report of 2011 delinquent real estate taxes with the County. Eight properties are delinquent with a face value of $3,541.87, and penalties of $354.28.

Public Comment: Dale Beckett, 15 Linden Ave., stated that the Springfield Garden Apartments, 144 S. Morton Ave., installed security lights that shine on his and his neighbors’ properties, all night. Mayor Lebold will talk with the Mayor of Morton Borough to see if the lights can be adjusted.

There was a piece in the Daily Times Soundoff stating that parking tickets are not issued to overnight parked cars on Linden Ave. Mayor Lebold spoke with Chief Brian Craig about the issue.

The ban on texting while driving goes into effect on March 7, 2012. Chief Brian Craig stated that the State Police will have a conference on how to enforce the law.
Residents are asked to lock their cars.

Rutledge Girls’ Club- Nothing to report.

Communication: Marlaina Kloepfer asked that any information to be posted on the Borough’s Facebook page or Listserve be forwarded to her.
Ordinance: Brian Costello reported that he is attending a seminar on Zoning at West Chester University. It is informative but very complex.

Trash: Nothing to report.

Building: Nothing to report.

Highway: David Waltz stated that he is working with the Engineer on an application with the PA Infrastructure Bank for a low-interest $125,000.00 loan for road repairs. The estimate to repair Swarthmore Ave. from Melrose Terrace to Waverly Terrace is $50,000.00.
The contractor who filled in three potholes on Unity Terrace will do a free survey of temporary pothole repairs that could be done throughout the Borough.
Street signs are needed for the intersection of Linden Ave. & Waverly Terrace.

MOTION by David Waltz, Second by Tom Kopp, to apply for County Aid for road repairs for 2012 in the amount of $1,485.00. MOTION approved unanimously.

Sewer: Daniel Werner reported that he submitted a rough draft of a report to address sewer and trash issues. When finalized, the report will be delivered to residents.

Public Safety: Tom Kopp reported the activities for the Morton-Rutledge Fire Co. for February.

Finance: Brian Costello thanked the Treasurer for the December 2011 Income and Expense Report.

Property/Borough Building: Diane McGaughey reported that the Borough received an energy reduction grant distributed by Delaware County Council in the amount of $14,210.00. Interior and exterior light fixtures will be replaced with energy efficient fixtures.
Two signs on the Borough building were repainted and will be installed this month.

Solicitor’s Report: The trash contract was given to the Secretary to be signed.

Public Comment: Kevin Cunningham, 20 Rutledge Ave., Rutledge Girls’ Club, thanked Council for the Diamondtek dirt for the infield at the Triangle Park. There will be 3 teams of 38 girls. On March 27, 2012, Zaq’s Hamburgers, from 5PM to 8PM, will donate 10% of sales to the Rutledge Girls’ Club.

Bills for March 5, 2011:

MOTION by Brian Costello, Second by Tom Kopp, to approve payment of the bills for the month from the General Fund in the amount of $6,708.48. MOTION approved unanimously.

Mayor’s Report: Mayor Lebold reported that there was a Sound Off complaint in the Delaware County Daily Times regarding cars parked overnight. The Swarthmore Police contract expires at the end of 2012. Tom Kopp, Greg Lebold and Diane McGaughey will work on negotiations for a new police contract.

Building: Nothing to report.

Communication: Marlain Kloepfer is to be contacted if anything comes up for the website or Facebook page. Seminar on May 17, 2012- Communicating in the 21st Century- Ms. Kloepfer will attend.

Finance: Brian Costello would like a cash flow report quarterly.

Ordinance: Nothing to report.

Property/Borough Building: Diane McGaughey reported that the Borough received a grant of $14,210.00 for energy efficiency- replace Exit signs, replace 1st floor Community Center lights, replace 2 outside lights, and replace some streetlights, all with LED low energy lights.
Rosalie Morral painted the two outside signs.

Public Safety: Tom Kopp thanked Council for the fruit arrangement. Jerry Connelly sent invitations to Council to the Morton-Rutledge Banquet in March.

The Fire Co. needs Diane McGaughey to sign the title of the GMC Jimmy over to the Fire Co.

Recreation: Marie Govannicci met with the 4th of July Committee. The Easter Egg Hunt date is to be determined.

The Rutledge Girls’ Club had 3 signups for softball.

Ms. Govannicci has been monitoring the activity at the basketball courts. She went on a warm, sunny day to speak with the boys using the court. The age range was from 18-24, and they have pickup games. They were respectful to her. Karl Eilinsfeld stated that trash has been left at the park near the basketball court.
David Waltz stated that he met with an electrician regarding electricity at the Triangle Park.
Mr. Waltz spoke with Kevin Cunningham regarding dirt at the infield of the softball field. He got a price of $96/yard and free delivery. 4 yards are needed.
MOTION by Marie Govanicci, Second by Brian Costello, to authorize the purchase of 4 yards of Diamondtek infield dirt, at a cost not to exceed $96.00/yard. MOTION approved unanimously.

Sewer: Daniel Werner had sent a draft report regarding inflow and infiltration into the sewer system to be distributed to residents after Council reviews the document.
David Waltz stated that he had discussed sewer repairs with Charles Catania and Representative Joe Hackett. They suggested that Rutledge apply for funds from PennVest. A list of sewer blockages in the sewer mains is needed.

Tree Commission: Karl Eilinsfeld submitted a letter to Council, requesting that Jack Borsch be appointed as a Tree Commission Member. MOTION by Marie Govanicci, Second by Brian Costello, to appoint Jack Borsch as a member of the Rutledge Borough Shade Tree Committee. MOTION approved unanimously.

Highway: David Waltz is to complete an application for a PennDOT loan for road repairs. Mr. Waltz spoke with Representative Joe Hackett about obtaining County funds to repair Swarthmore Ave.
The roads to be repaired are Waverly Terrace from Rutledge Ave. to President Ave., and Unity Terrace from Rutledge Ave., to Sylvan Ave., and part of Unity Terr. from Sylvan to President.
The grant from the County, $1,485.00 per year, now totaling $8,910.00 must be used in 2012, or forfeited. Mayor Lebold reported that Liquid Fuels funds may now be used for curbing.
Mr. Waltz will order street signs for Waverly Terrace and Linden Avenue.

MMEAC: Meeting 02/28/12, 7:30 PM, Furness Library in Wallingford. Diane McGaughey will attend.

Old Business: Two email inquiries were received regarding the representative to CDCA position. Daniel Werner will attend the meetings until someone else fills the position.

Karl Eilinsfeld reported that the snow blower broke and could not be repaired. He purchased a new one for $499.00.

New: Ms. McGaughey suggested that the Borough have a cleanup day for residents.

Karl Eilinsfeld asked if the group home at 1 Sylvan Ave. pays trash and sewer fees- yes.

Tax Collector’s Report: Thomas Heron reported that the 2012 tax bills were sent out by January 31, 2012, with a total face value of $399,017.00. $32,000.00 is uncollected from 2011.

Mayor’s Report: Mayor Greg Lebold read the police report for January 2012.

Police Chief Brian Craig reported that there have been daytime burglaries in Swarthmore. The suspects knock on the front door. If there is no answer, they break in via the back door. Chief Craig asked residents to report any suspicious persons.

4th of July: Quizzo on Saturday, 02/11/12, 7:00 PM. The committee will meet on the 2nd Monday of each month- 02/13/12 is the next meeting.

Rutledge Girls’ Club- Kevin Cunningham thanked Council for the 2011 donation. Softball signups have started, and 3 or 4 teams are expected. Mr. Cunningham submitted a letter to request use of the field for the Girls’ Club softball season. Background checks will be done on any new coaches. Mr. Cunningham stated that infield dirt is needed at the softball field, and will meet with Marie Govannicci to discuss.

Communication: Marlaina Kloepfer stated that Marie Govannicci volunteered to serve on the committee. The Committee will meet on a regular basis and try to make things more seamless. They will look at the website to make sure it is meeting the needs of the community, and will revisit the Borough Newsletter.

Ordinance: Brian Costello stated that some ordinances need to be revised because they are not clear, and the Ordinance and Building Committees go hand in hand.

Trash: Daniel Werner stated that the Borough has a 5-year contract with Suburban Waste Services, Inc.

Building: Brian Costello reported that Marlaina Kloepfer and Daniel Werner volunteered to be on the Building Committee. Mr. Costello stated that the Committee wants to revise certain ordinances by working with the code enforcement officer and the solicitor, and formalize procedures for building permits and Use & Occupancy Permits.

Highway: David Waltz stated that Tom Kopp volunteered to serve on the committee. Mr. Waltz would like to replace more signs, and replace the Borough truck.

Sewer: Daniel Werner stated that David Waltz volunteered to serve on the committee. Mr. Werner would like to educate residents about inflow and infiltration into the sanitary sewer system, and how the unnecessary treatment of I&I increases sewer bills. 2012 sewer fees increased by 39% from 2011 fees. 2011 had record-breaking rainwater. Some residents’ vent pipes are below ground, and stormwater is getting into the sanitary sewer system. 2011’s sewer flows will be reflected in the 2013 sewer fee.

Mr. Werner would like to generate a circular regarding inflow and infiltration into the sanitary sewer system and hand deliver it to residents, and initiate a 5-year plan for repairs. He has reviewed that video inspection CDs, and noted some failures at joints. Mr. Werner would like to get State funding to repair the Borough’s sewer system.

Shade Tree Commission: Nothing to report.

Recreation: Marie Govannicci reported that Marlaina Kloepfer and David Waltz volunteered to serve on the committee. Ms. Govannicci stated that she would like to beautify and maintain the Triangle Park, and work with the Girls’ Club. Ms. Govannicci would like to implement a report to review the safety standards at the Triangle Park, and have electricity installed at the Park.

Public Safety: Nothing to report.

Finance: Brian Costello stated that he completed a revised budget model, and will have a year to date report with an explanation of variances.

Property/Borough Building: Diane McGaughey stated that the front door, 1st floor of the Community Center needs replacement; there is a hole in the ceiling on the 2nd floor in the stage area, and needs painting, and the floors need to be stripped and waxed.

Multi-Municipal Energy Action Committee: Meeting on 02/28/12, 7:30 PM, Helen Furness Library in Wallingford.

Solicitor’s Report: Solicitor Guy Smith stated that the sewer treatment fees have increased. The Borough is a pass through agency; the fees are determined by DELCORA and Central Delaware County Authority. Residents are paying to treat liquids put into the system that don’t need to be treated. Sump pumps in homes and stormwater getting in sewer laterals are the biggest sources of inflow and infiltration.

The County sent a form resolution -Hazard Mitigation Plan of 2011- that the Borough is required to pass, to qualify for FEMA funds in the event of a disaster. The Borough has 1 year to adopt the resolution, and a disc of the County adopted, 300 page resolution was sent to the Borough for consideration. To be discussed at the Work Session.

A disc of the 11/1/11 County meeting that discussed the National Flood Plain Ordinance was sent to the Borough, with a request to pass a proposed ordinance. Solicitor Smith will contact the County because the request is not clear.

Old Business: Brian Costello stated that final drawings were submitted for the garage at 205 Sylvan Ave.

New Business: Marie Govannicci reported on the 2-day New Officials Training seminar that she attended. She learned budget planning, services that are provided to residents, the importance of committees, Sunshine Laws and the importance of not violating them. She learned that Council is here for the residents who elected them, and personal issues should not affect Council members’ decisions when deciding what is best for the Borough and its residents. Municipalities should work together to control costs.

Daniel Werner also attended the seminar, and learned the importance of the Sunshine Act, and that Council Members are personally liable for any violations. Council cannot discuss privately, only at advertised public meetings, anything that affects taxpayers’ money. There can be no requests for straw votes via email.

Daniel Werner volunteered to be Rutledge Borough’s representative to CDCA until a replacement may be found.

MOTION by Brian Costello, Second by Marie Govanicci, to appoint Daniel Werner as Rutledge Borough’s representative to CDCA, to complete the term vacated by Jack Borsch. MOTION approved unanimously.

Building: Brian Costello reported that he received plans for the proposed garage at 205 Sylvan Ave., Roe & Hamm Morrall. Mr. Costello recommends approval of the garage/addition. Daniel Werner and Marlaina Kloepfer volunteered to assist Mr. Costello on the Building and Ordinance Committees.

Communication: Marlaina Kloepfer reported that the Borough Facebook page is up, and 29 people like it. Softball signups and Quizzo have been posted. 1 comment stated that the Rutledge sign is incorrect and should be taken down. Another comment was about cats roaming the Borough. The meeting and holiday schedules will be posted. The 4th of July Committee would like to sponsor a food collection to be given to Chambers Memorial Church.
David Waltz asked that the calendar on the Borough website be updated.

Finance: Brian Costello asked that a report that shows income and expenses be distributed to Council quarterly.

Ordinance: Nothing to report.

Property/Borough Building: The front door to the Community Center, 1st floor, Sylvan Ave., needs to be replaced. There is hole in the ceiling on the second floor that needs repair.

Public Safety: Morton Borough cannot afford to pay the full $37,500.00 for the Fire Truck Reserve requested by the Fire Co. for 2012. They will pay $21,000.00. Rutledge Borough’s payment will be the same percentage that Morton Borough pays.

Recreation: Girls’ Club softball signups will take place in February. The 4th of July Committee would like to have electricity at the Triangle Park. The Committee has a lot of proposed events for Council to consider.

Trash: Daniel Werner requested a copy of the trash contract.

Sewer: Daniel Werner will make recommendations for sewer repairs from the report submitted by Catania Engineering, and complete the Chapter 94 Report.

Tree Commission: There is a meeting on February 8, 2012.

Highway: David Waltz stated that Karl Eilinsfeld did a great job plowing. The salt spreader is not working properly and the snow blower died.

Multi-Municipal Energy Action Committee- There will be 4 meetings in 2012, and Council is invited to attend.
Old Business: Nothing to report.

New: Rutledge Borough needs a representative to Central Delaware County Sewer Authority to complete the term vacated by Jack Borsch. It is for 2 years, and compensation is $400.00 per year. If the representative serves on Borough Council, he/she cannot receive compensation. Marlaina Kloepfer will post the position on the Borough website.

Snow Removal- Diane McGaughey stated that cars parked on the Terraces hinder snow plowing and suggested that an ordinance be passed to prevent parking.

Committee appointments- Diane McGaughey asked Council to inform her which committees they would like to serve on. Daniel Werner volunteered to serve on the Highway Committee.

Parking Tickets- Considering increasing the fine for overnight parking from $10.00 to $15.00.

Loan for Road Repairs- TD Bank sent an email stating that they are no longer interested in lending Rutledge Borough $110,000.00. They are interested in lending $1Million and more. David Waltz will see if Bryn Mawr Trust is interested.

Delaware County sent a CD regarding a Hazard Mitigation Plan. Rutledge Borough needs to pass an ordinance adopting a plan. There will be no FEMA assistance if no ordinance is passed. The Solicitor will review the information.

A CD from the November 18, 2011 Flood Plain Ordinance Meeting was referred to the Solicitor. Municipalities must pass a Flood Plain Ordinance.

Vice President - Mayor Greg Lebold called for nomination of Borough Council Vice President. MOTION by Daniel Werner to nominate David Waltz as Council Vice President.
