Diane McGaughey, Council President, opened the scheduled Work Session Meeting at 7:30 PM, in the Council Meeting Room, 212 Unity Terrace, Rutledge, PA.
After the salute to the flag, the following Council Members answered roll call: Daniel Werner, Diane McGaughey, David Waltz, Brian Costello, Marlaina Kloepfer, and Marie Govannicci

Building: Brian Costello reported that he received plans for the proposed garage at 205 Sylvan Ave., Roe & Hamm Morrall. Mr. Costello recommends approval of the garage/addition. Daniel Werner and Marlaina Kloepfer volunteered to assist Mr. Costello on the Building and Ordinance Committees.
Communication: Marlaina Kloepfer reported that the Borough Facebook page is up, and 29 people like it. Softball signups and Quizzo have been posted. 1 comment stated that the Rutledge sign is incorrect and should be taken down. Another comment was about cats roaming the Borough. The meeting and holiday schedules will be posted. The 4th of July Committee would like to sponsor a food collection to be given to Chambers Memorial Church.
David Waltz asked that the calendar on the Borough website be updated.
Finance: Brian Costello asked that a report that shows income and expenses be distributed to Council quarterly.
Ordinance: Nothing to report.
Property/Borough Building: The front door to the Community Center, 1st floor, Sylvan Ave., needs to be replaced. There is hole in the ceiling on the second floor that needs repair.
Public Safety: Morton Borough cannot afford to pay the full $37,500.00 for the Fire Truck Reserve requested by the Fire Co. for 2012. They will pay $21,000.00. Rutledge Borough’s payment will be the same percentage that Morton Borough pays.
Recreation: Girls’ Club softball signups will take place in February. The 4th of July Committee would like to have electricity at the Triangle Park. The Committee has a lot of proposed events for Council to consider.
Trash: Daniel Werner requested a copy of the trash contract.
Sewer: Daniel Werner will make recommendations for sewer repairs from the report submitted by Catania Engineering, and complete the Chapter 94 Report.
Tree Commission: There is a meeting on February 8, 2012.
Highway: David Waltz stated that Karl Eilinsfeld did a great job plowing. The salt spreader is not working properly and the snow blower died.
Multi-Municipal Energy Action Committee- There will be 4 meetings in 2012, and Council is invited to attend.
Old Business: Nothing to report.
New: Rutledge Borough needs a representative to Central Delaware County Sewer Authority to complete the term vacated by Jack Borsch. It is for 2 years, and compensation is $400.00 per year. If the representative serves on Borough Council, he/she cannot receive compensation. Marlaina Kloepfer will post the position on the Borough website.
Snow Removal- Diane McGaughey stated that cars parked on the Terraces hinder snow plowing and suggested that an ordinance be passed to prevent parking.
Committee appointments- Diane McGaughey asked Council to inform her which committees they would like to serve on. Daniel Werner volunteered to serve on the Highway Committee.
Parking Tickets- Considering increasing the fine for overnight parking from $10.00 to $15.00.
Loan for Road Repairs- TD Bank sent an email stating that they are no longer interested in lending Rutledge Borough $110,000.00. They are interested in lending $1Million and more. David Waltz will see if Bryn Mawr Trust is interested.
Delaware County sent a CD regarding a Hazard Mitigation Plan. Rutledge Borough needs to pass an ordinance adopting a plan. There will be no FEMA assistance if no ordinance is passed. The Solicitor will review the information.
A CD from the November 18, 2011 Flood Plain Ordinance Meeting was referred to the Solicitor. Municipalities must pass a Flood Plain Ordinance.

Highway: David Waltz stated three potholes on Unity Terrace were filled, and the work is guaranteed for 2 years. Mr. Waltz would like to meet with the contractor to survey the Borough and give a price to repair the potholes.
Sewer: Council President Diane McGaughey appointed Daniel Werner as Chairman of the Sewer Committee.
Shade Tree Commission: Nothing to report.
Recreation: Marie Govannicci was appointed as Chairperson of the Recreation Committee.
Public Safety: Tom Kopp reported that he will have the December and 2011 Annual Report at the next Council Meeting.
Santa’s ride through town went well, and took 45 minutes less than last year. The Fire Co. will work on better signs for next year; some signs were missing.
Mr. Kopp reported that the last stop is always Pete Black’s house for a reception. This is the 57th year that Mr. Black has held a reception for the Fire Co.

Finance: Brian Costello reported that the 2012 Budget was approved at the Work Session on December 19, 2011.

Old Business: David Waltz stated that Harry Mirra needs to work on enforcement of the bamboo ordinance. Mayor Lebold stated that a formal complaint must be made, and Mr. Mirra will respond to it, and the Solicitor will notify the homeowner.
New Business: Council President Diane McGaughey asked Council for 2012 goals for the Borough, to be discussed at the Work Session on January 23.

Public Comment: Diane McGaughey thanked Jack Breslin for all of the time and effort he put into selling the fire truck. Mr. Breslin thanked Council, and stated that the buyers are pleased with the truck.

Finance: Brian Costello reported that there is a modification to the Sewer Fund explanation for the 2012 budget: the increase in sewer fees is 39%, and not 110%. This does not affect the 2012 sewer fee amount.
Ordinance: MOTION by David Waltz, Second by Tom Kopp, to approve Ordinance 461, an ordinance that adopts regulations for the planting, growing, or cultivating of bamboo. MOTION approved unanimously.
Diane McGaughey stated that the peddling/solicitation ordinance needs to be revised.
Property/Borough Building: Nothing to report.
Public Safety: Tom Kopp reported that he gave Santa Claus’s Christmas Eve route to Marlaina Kloepfer to post on the Borough’s website. Santa will stop once on each block in the Borough where signs are posted, and will start at the Rutledge Court apartments.
The Fire Marshall certificate runs out on January 6, 2012.
Morton Borough paid $37,500.00 for the new fire truck reserve to the Morton-Rutledge Fire Co. Rutledge owes $12,500.00.
Jack Breslin reported that the fire truck that is for sale has a buyer, who was going to come pick up the truck on Saturday, December 17, 2011, but Diane McGaughey was not available to sign the title. Mr. Breslin will make arrangements for the buyer to pick up the truck at a later date.
Recreation: Nothing to report.
Trash: The trash workers gave out envelopes to residents to solicit tips. This is allowed, per Council.
Jack Borsch reported that there is a small business in Rutledge that had 20 bags of leaves. Mr. Borsch suspects the person is bringing the leaves to his residence from his landscaping customers.
Sewer: Nothing to report.
Tree Commission: Jack Borsch reported that he and Karl Eilinsfeld planted two crape Myrtles at the Triangle Park.
Highway: David Waltz reported that the crosswalk signs were put up at the Triangle Park.
Mr. Waltz reported that Innovative Construction Services, Inc. will patch the three potholes on Unity Terrace between Rutledge & Sylvan Aves. for $600.00, with a 2-year guarantee.
MOTION by David Waltz, Second by Kurt Morrison, to approve the temporary repair of the three potholes on Unity Terrace between Rutledge & Sylvan Aves., to be completed by Innovative Construction Services, Inc., at a cost not to exceed $600.00, with a two year guarantee. MOTION approved unanimously.
Solicitor: Guy Smith reviewed Organization Meeting procedures for the January 3, 2012 meeting, and distributed oaths of office that he prepared. The certifications are needed in advance.
Old Business: The proposed County Animal Protection Board revised its contract to include the annual fee of $1,250.00 will be carried forward for the length of the contract, if no animals are brought to the facility that year. Council is not interested in participating at this time.
2012 Budget:
MOTION by Brian Costello, Second by Kurt Morrison, to approve the 2012 Budget as submitted, with the change in the explanation of the increase in the sewer budget- 39% increase rather than 110% increase. MOTION approved unanimously.
MOTION by Kurt Morrison, Second by Brian Costello, to pass Ordinance 460, an ordinance levying taxes in the Borough for 2012, establishing trash collection and sanitary sewer fees and penalty for late payment, 1% realty transfer tax, and per capita tax, now in effect under the local tax enabling act of 1966, its amendments and supplements. General Purposes tax rate: 4.68 mills; Trash collection: $183.21 per dwelling unit annually; Sanitary sewer system:$544.14 per dwelling unit annully ; Realty transfer tax 1%, and Per Capita Tax. MOTION approved unanimously.
MOTION by Jack Borsch, Second by Brian Costello, to approve Resolution 2011-12-02, a Salary & Benefits Resolution. MOTION approved unanimously.
MOTION by Brian Costello, Second by Kurt Morrison, to approve Resolution 2011-12-03, a resolution that authorizes the Borough Tax Collector to collect the annual sanitary sewer usage fee. MOTION approved unanimously.
MOTION by Kurt Morrison, Second by Jack Borsch, to approve Resolution 2011-12-04 a resolution that authorizes the Council President, Vice President, and Secretary/Treasurer to sign checks. MOTION approved unanimously.
MOTION by Kurt Morrison, Second by Brian Costello to approve Resolution 2011-12-05, a resolution to appoint the following auditors for fiscal year 2012: Catherine Myers, Paul S. Garrity, and Jack Borsch. MOTION approved with a majority vote (Jack Borsch abstained.)
Diane McGaughey read the 2012 holiday schedule, which will be posted on the bulletin board outside the Borough building, and on the Borough website.
New: A new Recycling Coordinator needs to be appointed.
A new PA One Call contact person needs to be appointed. Jack Borsch stated that he will continue serving until someone is appointed.
A new CDCA (sewer authority) representative needs to be appointed to complete the 2 years left in Jack Borsch’s term. There is no compensation for Council members. Marlaina Kloepfer will put it on the Borough website.
MOTION by Brian Costello, Second by Jack Borsch, to appoint Tom Kopp as Fire Marshall. MOTION approved unanimously.
Mr. Kopp reported that the homeowners of 17 President Ave. are still working with the insurance company and insurance adjuster to come to a settlement on replacement price.

Tax Collector’s Report: Thomas Heron reported that there is no change in 2011 uncollected taxes: $32,000.00. Mr. Heron has submitted an application for bond renewal, and ordered bill from the County.
Public Comment: Michelle Senior, 100 Rutledge Ave., stated that the road is still coming apart. Ms. Senior asked if letters were sent regarding the Prevailing Wage Act. Solicitor Smith stated that the bill is on the table for consideration. It is too late for any road repairs in 2011. Ms. Senior asked if there is a temporary fix, because she picks up about 10 pieces of asphalt a day. Mayor Lebold stated that Catania Engineering will be contacted to see if any temporary repairs can be done.

Santa Claus will start his Christmas Eve ride through the Borough at 5:00 PM, at the Rutledge Court Apartments, 12/24/11. This year, Santa will stop once on each block at a location indicated by a sign.
Former Rutledge Fire Chief, Bill Kruse, died at age 78.
Jack Breslin has a prospective buyer for the fire truck; they want it brought to their fire station on Saturday, December 10, 2011. MOTION by Tom Kopp, Second by David Waltz, to pass Resolution 2011-12-01 that authorizes Council President Diane McGaughey to sign the title for the sale of the 1982 Sutphen Class A Pumper. MOTION approved unanimously.
Finance: Brian Costello reported that the 2012 draft Budget was approved at the November Work Session, and the final budget will be approved at the Work Session on December 19, 2011.

MOTION by Brian Costello, Second by Kurt Morrison, to authorize the Secretary to advertise the 2012 Meeting Schedule. MOTION approved unanimously.
The newly formed County Animal Protection Board requests a letter of intent from Rutledge, by December 16, 2011, to join the organization. The Delaware County SPCA will no longer accept stray animals from municipalities. Delaware County is building a shelter in Darby Twp. to accommodate strays in Delaware County. The cost is $1,250.00/year for 3 years- 2012-2014, and allows 5 strays per year. Additional animals are $250.00 each. Nothing is mentioned about carrying over the fee if no animals are brought to the shelter. The Chester County will accept strays until the County facility is built.
Public Comment: Marie Govannicci, 221 Sylvan Ave., reported that the luminaries will be placed on the curbs on 12/24/11 at 9:30 AM. Bags will be filled with sand on 12/16/11, at 1:30 PM at the old Rutledge Fire House. Volunteers are needed.
Christine Graedel, 121 President Ave., inquired as to the wording of the bamboo ordinance. Solicitor Smith will get a copy to her. Ms. Graedel questioned whether animal control will pick up foxes and raccoons. Mayor Lebold explained that is a private property matter, and the Borough is not responsible for removal of them.
