Rutledge Borough Work Session-March 24, 2014

David Waltz, Council President, opened the scheduled Work Session Meeting at 7:30 PM, in the Council Meeting Room, 212 Unity Terrace, Rutledge, PA.

After the salute to the flag, the following Council Members answered roll call:, Marlaina Kloepfer,  David Waltz, Tom Kopp, James Jones, Marie Govannicci, Daniel Werner

Also present: Mayor Kevin Cunningham, Robert Hunt, Jr., Esq.

Not Present: Diane McGaughey

Public Comment; Karl Eilinsfeld, 223 Linden Ave. stated that the rain garden sign at the playground is illegible, the basketball hoops are rusted, and a pipe from the old sliding board is sticking up. The backdoor at 230 Linden Ave. is open and unlocked.

The walls are caving in on the storm drain at Sylvan and Linden Aves.

Jack Breslin. 136 Linden Ave., asked for an update on the gas company- when will the Linden Ave. project be finished. David Waltz stated that the work will be done when the weather breaks.

Marjorie Corcoran, 124 Rutledge Ave., requested an update on funding for the softball field improvements such as Diamond Tech dirt for the infield, replace home plate, build up the pitcher’s mound, replace 2nd base. Ms. Corcoran received quotes and gave them to Marie Govannicci.

Public Safety – Tom Kopp reported that the 3-yr pressure test required by the State on the elevator has been completed. He will get a proposal for a maintenance contract.

The Fire Co. will sell food at the April 5, 2014 Craft Show.

Recreation – Marie Govannicci stated that the 4th of July Committee will have an Easter Egg Hunt on April 13, 2014 at the Triangle Park. There is no rain date.

Ms. Govannicci received quotes for work at the ball field at the Triangle Park from J. Jansen to dig out poles, fill in the gully at the slide and install 45 yards, 2” thick mulch for a price of $2,296.00. MOTION by Marie Govannicci, Second by Daniel Werner, to accept the proposal of J. Jansen to complete work at the Triangle Park- dig out poles, fill in gully at slide, install 45 yards 2” thick mulch, at a cost not to exceed $2,296.00. MOTION approved unanimously.

The Girls’ Club received two prices to repair, fill and cut the infield grass and install Diamond Tech, and replace 2nd base and home plate and pitcher’s mound at the ball park: J. Jansen- $1,272.00; Le Gros Inc.- $5,000.00.

MOTION by Marie Govanicci, Second by Jim Jones, to award baseball field work to J, Jansen at a cost not to exceed $1,272.00. There will be a donation towards this in the amount of $500.00. MOTION approved unanimously.

A new toy for the park will be ordered this week.

Streets – David Waltz reported that Karl Eilisnfeld is filling potholes. The County is awarding up to 35% of municipalities’ annual County aid amount for road repairs for pothole repairs. A record, including receipts, must be kept for reimbursement.

Improvements on Morton Ave. – Mr. Waltz spoke with Catania Engineering about the project. Morton Ave., from Ridley High School to Swarthmore Ave.- the road will widened and sidewalks and curbing will be put in, and the intersection will be a little wider. The project is scheduled for 2016. The residents are being contacted.

Sewer – Jim Jones reported that he received the sewer files from Daniel Werner. The Borough is going into the third year of its five year short term plan. Kim Brown, 32 President Ave. complained of two sinkholes on her property. Daniel Werner had been looking into a long-term solution of replacing the old terracotta pipes. The cost will be approximately $1 million. David Waltz appointed James Jones as Rutledge Borough’s representative to the CDCA Board for a five-year term.

Communications – Marlaina Kloepfer reported that the Committee is going through the ordinances to put them on the website. Ms. Kloepfer requested an electronic copy of the Easter Egg Hunt information to put on the website. The Planning Commission would like to host a Rain Barrel Workshop, and include Morton and Swarthmore.  Ms. Kloepfer has a job description for a summer intern, and will send out an email and also give it to Barbara Ormsby for the Delaware County Times.

Building – Daniel Werner received an email from a resident who wants to erect a garage in which to keep his boat. He discussed the plans with the homeowner, which may be declined. He was advised that he could apply for a variance.

The residents at 2 and 4 Unity Terrace have erected five foot fences, and did not apply for permits before the work was done. 4 Unity is for sale. A small porch was also put up, and the house was changed from three bedrooms to two bedrooms without obtaining permits.

Mayor’s Report – Mayor Cunningham reported that people are not calling 911. A resident thought he/she saw a drug deal go down, but did not call 911. It is listed on the website and in the newsletter. Mayor Cunningham is working on a Memorial Day ceremony with Harry Mirra. The Borough should recognize the people who were killed serving their country. The Mayor would like to have a meet and greet with Council and the residents.

Solicitor’s Report -  Solicitor Robert Hunt reported that there are enhanced penalties for those who commit theft against a municipality.

Old Business– The Girls’ Club would like to sell advertisements on the fence at the ball park as a fund raiser. The Ordinance Committee reviewed the ordinance and it is not allowed. The Planning Commission has concerns about safety and the ability to see what is going on at the park. The signs would be up during the softball season and taken down when it is over. Council can review and allow the signs temporarily.

County Act 537 Sewage Plan – The County has completed a new plan that required approval in 2012 for them to do it, and approval of the final plan in 2013, by resolution. The Planning Commission must also submit a letter stating that the Commission has reviewed the plan.

MOTION by Marie Govannicci, Second by Daniel Werner to approve Resolution 2014-03-01, a Resolution that   MOTION approved unanimously.

Diane McGaughey has 30 years of service to the Borough as of January 4, 2014. Marlaina Kloepfer will contact the Delaware County Association of Boroughs to see hat awards/recognition is available.

CDCA has three portable flow meters to loan the Borough. The Borough must pay for installation and maintenance.

New Business – David Waltz stated that the Borough has gotten a phone call about the cheerleaders at the old firehouse. The complaints were about loud music and the door being open, at 3:00 PM. The police were called a few times, and none of this occurred when they got there. The Fire Co. is providing community service for the schools because there is no space for practice at the schools. The cheerleaders have been told to keep the noise down. Jack Breslin stated that he had the doors open on Friday to load some Fire Co. equipment on his truck. There was no music playing and the cheerleaders were not there. The police came because they had a complaint from the homeowners at 15 Sylvan Ave., and saw that there was no music playing. The Fire Co. spoke with other neighbors, and they had no complaints.

Council is looking into increasing the apartment license fee from $50.00 per unit in the 2015 Budget.
