Greg Lebold, Council President, opened the resumed Borough Council Meeting at 7:30 PM, in the Council Meeting Room, 212 Unity Terrace, Rutledge, PA.
After the salute to the flag, the following Council members answered roll call: Greg Lebold, Tom Kopp, Jack Borsch, Diane McGaughey, Mark King, Todd Ash and Kurt Morrison.
Also present: Mayor Scott Shields, G. Guy Smith, Solicitor, Ed McGaughey, Borough Manager
Diane McGaughey reported that she received an amended budget from CDCA for sewer rates for 2008. Rutledge will charge $261 per sewer unit for 2008. Ms. McGaughey asked if there were any grants for sewer work. The Delaware County Borough Association wants to push the County to give Boroughs grants; Townships have been receiving the majority of the grants.
Discussed resolutions for the Tax Collector and tax ordinances.
Reviewed a letter to go out regarding the new trash collectors.
The next Work Session will be on December 17, 2007.
Triangle Park work as been completed. Catania Engineering is to do a final inspection. The County grant is for $64,200; the balance of $10,370 will have to be paid from the reserve account. There are an additional $2,925.00 in engineering fees that need to be paid, also.
Ed McGaughey stated that an application for Renaissance Grant from the County should be explored.
MOTION by Kurt Morrison, Second by Diane McGaughey, to transfer $13,295.00 from the Capital Reserve Account to pay the balance of the Triangle Park Improvement Project. MOTION approved unanimously.
MOTION by Kurt Morrison, Second by Diane McGaughey, to authorize payment to JFC Contractors in the amount of $10,370.00, as final payment for the Triangle Park Stormwater Project. MOTION approved unanimously.
Discussed the Corcoran. Hanser Subdivision at 232 Sylvan Ave. Mr. Corcoran needs to get a reverse subdivision from the Borough. The reverse subdivision granted by the Borough does not guarantee that the Zoning Hearing Board will grant the requested zoning variance or deny it. The Hanser property has 2 separate folio numbers. Council can approve the reverse subdivisions subject to the applicant getting relief from the Zoning Hearing Board. Proof of ownership needs to be provided.
The Zoning Hearing Board needs to have a conditional agreement of sale, stating that the Corcorans will buy the Hanser property if the zoning variance is granted.
MOTION by Diane McGaughey, Second by Mark King, to approve the reverse subdivision of the Hanser/Corcoran property located at 232 Sylvan Ave., subject to: 1) a written agreement of sale presented to Council, 2) approval is subject to actual transfer of ownership, 3) ownership neither creates, enhances, or reduces any hardship for the purpose of the Zoning Hearing Board applications. MOTION approved unanimously.
Appointments that need to be made in January, 2008: Health Office, UCC Officer for Code Enforcement
Since there was no further business, the resumed Council Meeting was adjourned at 8:45 PM.
