AN ORDINANCE OF THE BOROUGH OF RUTLEGE AMENDING
ACCESSORY USES AND STRUCTURES,§27-603, OF THE
BOROUGH OF RUTLEDGE’S ZONING ORDINANCE
WHEREAS, the existing Zoning Ordinance regulates the acceptable accessory uses and
structures in the Borough of Rutledge;
WHEREAS, after consideration of the Planning Commission’ s investigation and
recommendations relating to Accessory Uses and Structures, the Borough Counsel has
determined to accept these recommendations.
WHEREFORE. the Council of the Borough of Rutledge does hereby ORDAIN a s follows :
SECTION 1The Borough of Rutledge Zoning Ordinance §27-603 is hereby amended to read as
follows:
1 . Accessory structures such as garages, decks, sheds , pool house, gazebo, patios, or
similar structure, shall be located only in the side or rear yards.
2 . No accessory structure shall be more than 20 feet high to the mid-point of the roof,
midway between the highest and lowest points of the highest roof.
3 . The minimum setback for accessory structures shall be 5 feet at both the side and rear
lot lines, unless specifically stated otherwise in this Chapter.
4 . Accessory structures shall not be used as an apartment, dwelling unit or for overnight
sleeping. Under no instance shall a bed and breakfast or family day-care home facility
be allowed to operate within an accessory structure.
- A private garage may be erected within a rear yard or side yard, provided that it is
attached to or located at least 20 feet farther back than the rearmost portion of the
principal building, except as modified by §27-603(2), above. Garages shall not occupy
more than 60 0 square feet and must comply with §27-603 (3), above. Whether or not the
garage is attached to or detached from the dwelling, the entirety of the garage must be
set back at least three feet from the street-facing facade of the dwelling.
6 . That an egress window shall be required for structures on the second floor such as in a
garage, pool houses or similar structures and in conformance with the applicable
Building and Fire and Safety Codes,
- Only one utility/storage shed shall be permitted on a lot.
- Sheds shall not have a floor area exceeding 120 square feet and not be more than 12
feet high to the peak of the roof.
SECTION 2. Borough Council authorizes the appropriate Borough officials, officers, solicitor
and employees to take any and all necessary actions required to carry out the intent of this
Ordinance.
SECTION 3. All Ordinances or resolutions or parts of Ordinances or Resolutions, insofar as
they are inconsistent herewith, are hereby repealed.
