RUTLEDGE BOROUGH COUNCIL MEETING-February 4, 2013

M. Diane McGaughey, Council President, opened the scheduled Borough Council Meeting at 7:30 PM, in the Council Meeting Room, 212 Unity Terrace, Rutledge, PA.

After the salute to the flag, the following Council members answered roll call: M. Diane McGaughey,  Marlaina Kloepfer,  Marie Govannicci, Brian Costello and David Waltz.

Also present: Mayor Kevin Cunningham, G. Guy Smith, Esq., Police Chief Brian Craig, Robert Hunt., Jr., Esq.

Not present: Daniel Werner, Tom Kopp

Minutes:  MOTION by David Waltz, Second by Brian Costello, to approve the minutes as submitted for the Council Meeting of January 17, 2013. MOTION approved unanimously.

MOTION by Brian Costello, Second by David Waltz, to approve the minutes as submitted for the Work Session of January 28, 2013.  MOTION approved unanimously.

Treasurer’s Report: Gennifer Guiliano distributed the Treasurer’s Report for the month of January, 2013. The Borough is low on cash in the General Fund, used to pay operating expenses. $40,000.00 was transferred from the General Reserve Fund to cover expenses until 2013 taxes are received.

Correspondence:

1) PA State Association of Boroughs- Offering a “FREE” prescription drug card discount program for Borough Officials, employees, retirees and their families

2) Delaware County Chapter of the PA Society of Professional Engineers –February 20 Dinner Meeting, 6:00 PM Towne House Media, Charles Catania Sr. will be honored with a lifetime achievement award. Cost $35.00 for dinner

3) Department of the Auditor General- Liquid Fuels Fund Audit for the years 2009, 2010, 2011, beginning on February 12, 2013

4) PA State Association of Boroughs- Annual Conference, May 5-8, 2013, Hershey Lodge

Tax Collector’s Report: Thomas Heron reported that the 2013 tax bills have been sent out. Mr. Heron received a per capita list from the School District to use for the Borough’s Per Capita collection. There are six delinquent properties for 2012 taxes.

Public Comment: None

Mayor’s Report: Mayor Kevin Cunningham read the Police report for January. There were:

32 Parking Tickets       1 Warning        8 Motor Vehicle Citations
Mayor Cunningham reported that Chief Craig showed him around the police station on February 1.

1/17 Linden Ave.- change taken from unlocked car

1/18 Linden Ave. – items stolen from unlocked car

Marlaina Kloepfer will set up a webinar regarding Global Connect notification system for Council to attend.

Solicitor Smith will get a new Motor Vehicle Code book for the Mayor.

Music night will be held on February 23, 2013, from 7:00 PM to 10:00 PM at the Community Center.

Code Enforcement Report: Harry Mirra read his report for January 2013:

1 Tree limb fell on property – not removed

1 Garage floor sunk. PODS storage unit in driveway until construction is completed. The contractor will put in 6 feet of stone before pouring concrete.

There is a court hearing on February 14, 2013 for property maintenance issues at 7 Rutledge Ave. Cleanup has no started.

The garage at a rental property at 134 Sylvan Ave. is falling down. Mr. Mirra called the homeowner twice, and the homeowner came to the Work Session to discuss the situation with Council.

Zoning Permits:

200 Sylvan Ave.- garage floor  20% completed

15 Linden Ave.- New roof- 0% completed

4th of July: The next meeting in on February 11, 2013, 8:00 PM. The Committee is preparing for Quizzo Night on March 22, 2013.

Rutledge Girls’ Club– There is a new president. Softball signups will be in February.

Communication: Marlaina Kloepfer stated that she is accepting news for the Borough newsletter. There will be a Communications Committee Meeting on March 14, 2013 at 7:30 PM.

Ordinance: Brian Costello reported that two revised ordinances have been submitted to the Solicitor for review.

Trash: Nothing to report.

Building: Brian Costello reported that a garage on Sylvan Ave. needs to be repaired.

Recreation: Marie Govannicci stated that she is writing a grant to make changes at the Triangle Park. Ms. Govannicci would like to submit a proclamation to make the Triangle Park tobacco free.

Sewer: Nothing to report.

Shade Tree Commission: Marie Govannicci reported that there will be plantings in the fall. The next meeting will be on March 13, 2013, 7:00 PM.

Public Safety: Nothing to report.

Finance: Brian Costello stated that he reconciled the tax bills sent against the 2013 budget.

Property/Borough Building: Nothing to report.

Streets: Nothing to report.

Solicitor’s Report: Nothing to report.

Old Business: There is a trailer parked on Unity Terrace. The current ordinance does not allow it. Chief Brian Craig will make the owner aware of the ordinance.

New Business: Solicitor Guy Smith stated that a Debt Statement must be prepared for the PA Infrastructure Bank loan for road repairs that states that there are no bonds or notes outstanding. A certification of the vote on the Ordinance to borrow funds is required, as well as a resolution that authorizes the council President to sign the loan documents.

MOTION by David Waltz, Second by Brian Costello, to enter into a loan agreement with the Pennsylvania Infrastructure Bank to borrow $125,000.00 for 10 years at a rate of 1.625%. MOTION approved unanimously.

MOTION by David Waltz, Second by Marie Govannicci, to approve the general obligation note with Pennsylvania Infrastructure Bank for $125,000.00 for 10 years at 1.625%. MOTION approved unanimously.

MOTION by David Waltz, Second by Brian Costello, to approve Ordinance #465, an ordinance increasing the indebtedness of the Borough of Rutledge, Delaware County, Pennsylvania, by the issuance of a general obligation note in the amount of $125,000.00 for the repaving of certain streets in the Borough of Rutledge, fixing the form, number, date, interest, and maturity thereof; making a covenant for the payment of the debt service on the note; providing for the filing of the required documents; providing for the appointment of a sinking fund depository for the note; and authorizing execution, sale and delivery thereof. MOTION approved unanimously.

MOTION by David Waltz, Second by Brian Costello, to approve Resolution #2013-02-01 that authorizes the President of the Borough Council of Rutledge Borough to sign the loan agreement and all related documents on behalf of said Council. MOTION approved unanimously.

MOTION by David Waltz, Second by Brian Costello, to authorize the Secretary to advertise the ordinance that was passed to borrow funds from the Pennsylvania Infrastructure Bank. MOTION approved unanimously.

Public Comment: Kim Brown, 32 President Ave., stated that a truck with a trailer has been parked on Unity Terrace for three months. It has torn up the grass on her property, and she cannot see getting out of her driveway. The owner has multiple cars parked on Unity Terrace, and there is a truck filled with scrap metal parked there two days a week.

Anything that can be done to have the vehicles removed would be appreciated.

Bills for February 4, 2013:

MOTION by Brian Costello, Second by David Waltz, to approve payment of the bills for the month from the General Fund in the amount of $6,365.82. MOTION approved unanimously.

MOTION by Brian Costello, Second by David Waltz, to approve payment of the bills for the month from the Gas Fund in the amount of $1,296.12. MOTION  approved unanimously.

Since there was no further business, the meeting was adjourned at 8:15 PM.
