David Waltz, Council President, opened the scheduled Borough Council Meeting at 7:38 PM, in the Council Meeting Room, 212 Unity Terrace, Rutledge, PA.
After the salute to the flag, the following Council members answered roll call: David Waltz, Marlaina Kloepfer, Marie Govannicci, Kimberly Brown
Also present: Police Chief Brian Craig, Michael F. Culp, Esq., Fire Chief Dean Kemp
Not Present: Tom Kopp, John Shingle, Jim Jones, Mayor Kevin Cunningham
Public Comment: None.
Minutes: MOTION by Marlaina Kloepfer, Second by Marie Govannicci, to approve the minutes as submitted for the Council Meeting of April 4, 2016. MOTION approved unanimously.
MOTION by Marie Govannicci, Second by Marlaina Kloepfer, to approve the minutes as submitted for the Work Session of April 25, 2016. Â MOTION approved unanimously.
Treasurer’s Report: Gennifer Guiliano distributed the Treasurer’s Report for the month of April 2016. MOTION by Marie Govannicci, Second by Marlaina Kloepfer, to approve the April Treasurer’s Report as submitted. MOTION approved unanimously.

- Sten- Complaint about a contractor doing work at her neighbor’s property that affects her yard
- George Jameson- Folsom resident complained about noise from the Triangle Park
- Thomas Moleski- Fire Marshall-Recommendations for the fire pit ordinance
Tax Collector’s Report: Thomas Heron read his report for April 2016. $387,286.45 was collected as of April 30, 2016.
Code Enforcement: No report.
Mayor’s Report: Marlaina Kloepfer read the Police Report for April 2016. There were 45 Parking Tickets, 3 traffic tickets and 2 traffic warnings.
There will be a Memorial Day Service on Sunday, May 29, 2016 at 1:00 PM.
Public Safety: Dean Kemp read the Fire Co. report for April. There were 18 incidents, with time in service of 5 Hours 59 Minutes, 25 Hours 43 Minutes Manpower.
Building/Permits: Nothing to report.
Finance: David Waltz stated that the majority of taxes have been paid.
Property/Building Maintenance: Marlaina Kloepfer asked for keys to the Community Center to be kept in a central location.
Rutledge Activities Committee: Marie Govannicci reported that there will be a meeting on May 9 to discuss the Memorial Day and 4th of July festivities.
Rutledge Girls’ Club : Marie Govannicci provided a schedule of home games to Mark Bascelli.
Triangle Park: Marie Govannicci reported that three new picnic table have been installed and are well used. One was donated by Council President David Waltz. New swings have been delivered. Mark Bascelli will install them after he paints the swingset. All of the items noted by the insurance company have been completed.
Communication: Marlaina Kloepfer reported that the next meeting will be on Thursday, May 12, 2016, 7:30 PM. Ms. Kloepfer will put out an email for a summer intern.
Trash: Â Nothing to report.
Sewer: David Waltz reported that the sinkholes that were repaired last year at 32 President Ave. are back.
Shade Tree Commission: Marie Govannicci reported that there will be a meeting on May 19. The Commission would like permission to hang a 5’ X 3’ banner on the front of the Community Center to advertise the plant swap.
Marlaina Kloepfer thanked the members for doing a good job digging holes and planting trees for the residents in the rain.
Streets: David Waltz reported that Mark Bascelli has repaired potholes in the Borough. Mr. Waltz stated the he is looking at a municipal lease for a new Borough truck. We can no longer get parts to repair the current truck.
Solicitor’s Report: Nothing to report.
Old Business: MOTION by Kim Brown, Second by Marie Govannicci, to pass Resolution 2016-05-01, a Resolution to authorize Johnson Controls to perform an energy saving audit of the streetlights in the Borough of Rutledge. MOTION approved unanimously.
Marie Govannicci reported that Council had approved the purchase of two picnic tables for the Triangle Park, one to be donated by David Waltz. A third table was purchased for $400.00. MOTION by Marie Govannicci, Second by Kim Brown, to pay for another picnic table for the Triangle Park, at a cost not to exceed $400.00. MOTION approved unanimously.
New Business: Marie Govannicci stated that a resident filed a complaint with Borough Council because her neighbor’s contractor was removing an old fence, and used a chainsaw to cut it down. It was made of treated wood that has arsenic in it, and the shavings were all over her organic vegetable garden that she and her family had just planted. The resident called Penn State for advice . She has to move her garden to another location and replant it. President Waltz stated that it is a neighbor dispute, and he will go to see her to discuss the issue.
A Newtown Square resident is paying for a plaque representing each town in Delaware County at the Veteran’s Memorial. A saying for the plaque for Rutledge must be chosen. MOTION by Marlaina Kloepfer, Second by Marie Govannicci, to use “Home of the Free Because of the Brave†for Rutledge’s plaque. MOTION approved unanimously.

Bills for May 2, 2016:Â
MOTION by Marie Govannicci, Second by Marlaina Kloepfer, to approve payment of the bills for the month from the General Fund in the amount of $33,944.76. Â MOTION approved unanimously.
MOTION by Marie Govannicci, Second by Kim Brown, to approve payment of the bills for the month from the Gas Fund in the amount of $2,231.80. MOTION approved unanimously.
MOTION by Marie Govannicci, Second by Marlaina Kloepfer, to approve payment of the bills for the month from the Sewer Fund in the amount of $39,562.00. MOTION approved unanimously.
