Rutledge Borough Work Session, September 24, 2012

Diane McGaughey, Council President, opened the scheduled Work Session Meeting at 7:30 PM, in the Council Meeting Room, 212 Unity Terrace, Rutledge, PA.

After the salute to the flag, the following Council Members answered roll call: Diane McGaughey, Marlaina Kloepfer, Tom Kopp, Daniel Werner, Marie Govannicci, Brian Costello, David Waltz

Not present: Solicitor Guy Smith

Also present: Mayor Kevin Cunningham

Public Comment: None

Building: Brian Costello reported that new plans were received for the rebuilding of the house at 17 President Ave. Chili’s Inspection Service reviewed and approved them. The contractor requested that his workers be allowed to park on the other side of the street during construction. They may only park there to unload.
The new contractors at 25 President Ave. put up siding and new windows.

Communication: Marlaina Kloepfer reported that the 2012 voting information has been posted on the Borough website. Ms. Kloepfer thanked Kevin Cunningham for his Mayor’s Newsletter. Ms. Kloepfer is almost finished writing the Borough Newsletter, and will hand-deliver it to residents. There is a Borough Association Meeting on Tuesday, September 25, 2012, at 6:00 PM to review the new Borough Code. There was a Board Meeting on September 17, at which Ms. Kloepfer was appointed Director of the Board until the end of 2013.

Finance: Brian Costello reported that there has been one meeting to discuss the budget, and another is scheduled for Wednesday, October 3, 2012, at 10:30 AM.

Ordinance: Brian Costello reported that there are two proposed ordinance revisions. Daniel Werner responded with his thoughts on them. Mr. Costello will put the revisions in final form for the Solicitor’s review.

Property/Borough Building: Diane McGaughey reported that the floors on the second floor of the Community Center have been cleaned and waxed. The closets on the stage have been cleaned and organized. The front door was installed today. The stage area is off limits because the backdrop needs work.

Public Safety: Tom Kopp reported that the SPCA will have two more low cost clinics on 10/23/12 and 11/20/12.
There was a house fire at 139 Linden Ave.
There is a meeting on 10/02/12 with Swarthmore representatives to discuss police protection.

Recreation: Marie Govannicci will get another quote from Ed Mundy for the sidewalk blocks at the Triangle Park. Boyle concrete will send a quote for the work. The sliding board has been repaired and looks good.

4th of July Committee: The Silvertones from Strath Haven School will sing at the Borough’s holiday celebration on 12/03/12 at 7:00 PM.

Rutledge Girls’ Club: There are 12 girls on a full team, ages 12 and under. They won the first game.

Trash: Nothing to report.

Sewer: Nothing to report.

Tree Commission: There will be a meeting on Wednesday, December 12, 2012. Karl Eilisnfeld reported that the Tree Commission will give $100 to residents who plant trees in the Borough right of way. There are two applications pending.

Highway: David Waltz reported that he and Karl Eilinsfeld will paint lines on Swarthmore Ave. for speed evaluation by the police.

MMEAC: Marie Govannicci attended the last MMEAC meeting. They are trying to have a path that connects all of the Townships and Boroughs- Rutledge is not on the map, but neighboring communities are. They are looking into grants for sidewalks and curbing where school buses pick up and deliver children They are testing water in the creeks.

Mayor: Kevin Cunninham has spoken to several residents, and they are looking forward to the newsletter.

Solicitor: Nothing to report.

Old Business: Diane McGaughey stated that a new Solicitor must be appointed.
Went into Executive Session at 8:05 PM, and out of Executive Session at 8:15 PM.

MOTION by Brian Costello, Second by Daniel Werner, to appoint Robert Hunt as Borough Solicitor for one year, with confirmation that he will receive support from G. Guy Smith, Esq., and receipt of errors and omissions insurance policy. MOTION approved with a majority of YES votes. (Yes votes: D. Werner, M. Govannicci, D. McGaughey, B. Costello, M. Kloepfer; NO votes: T. Kopp, D. Waltz)

New: A resolution for tobacco-free outdoor areas was presented.

The Delaware County Association of Boroughs will have a Fall Festival at The Oaks on Friday, October 19, 2012, from 6PM to 10 PM.

The Council on Government (COG) is concerned about the pet population, especially cats.

The erection of cell towers was discussed at the last meeting.

There is a Rain Barrel/Backyard Buffers Workshop.

The Cohen Law Group will look at ordinances for cable companies for free and advise. Wireless internet connections are not included in the franchise fees.

Municipalities are advised to contact their State Legislatures to support the revised Prevailing Wage Act.

October is Red Ribbon Time, and a proclamation was requested for heart disease awareness.

The owners of 1 Sylvan Ave. will remove the brick sidewalk and put concrete.

7 Rutledge Ave. was cited for property maintenance issues. The hearing was changed from September 27 to November. 110 Sylvan was cited for bamboo, and there will be a hearing in October.

Brian Costello stated that he has looked at chapter 7 of the Ordinance Book that deals with open burning. With the popularity of fire pits, Council should consider revising the ordinance, because several families have inquired about it.

David Waltz stated that the Tax Collector missed the filing of delinquent taxes from 2010. Some houses in the Borough are scheduled for the Sheriff Sale. If the delinquent taxes are not recorded, the borough could lose out on the funds. The Secretary will contact the Solicitor tomorrow.

Since there was no further business, the meeting was adjourned at 8:41 PM.
