Rutledge Borough Council Meeting, September 10, 2012

M. Diane McGaughey, Council President, opened the scheduled Borough Council Meeting at 7:30 PM, in the Council Meeting Room, 212 Unity Terrace, Rutledge, PA.

After the salute to the flag, the following Council members answered roll call: M. Diane McGaughey, Daniel Werner, Marlaina Kloepfer, Tom Kopp, Marie Govannicci, Brian Costello and David Waltz.

Also present: Mayor Kevin Cunningham, G. Guy Smith, Esq., Police Chief Brian Craig

Minutes:  MOTION by David Waltz, Second by Marie Govannicci, to approve the minutes as submitted for the Council Meeting of August 6, 2012. MOTION approved unanimously.

MOTION by David Waltz, Second by Daniel Werner, to approve the minutes as submitted for the Work Session of August 27, 2012.  MOTION approved unanimously.

Treasurer’s Report: Gennifer Guiliano distributed the Treasurer’s Report for the month of August, 2012.

Correspondence:  Complaint from resident at 111 Linden Ave.- fox-like animals running around the 100 block of Linden Ave.

Tax Collector’s Report: Thomas Heron reported that there were no payments in August. Unpaid Real Estate Tax- $18,266.00; unpaid Per Capita Tax – $148.50; unpaid Sewer – $3,591.00. Total unpaid for 2012- $22,005.83.

Public Comment: Harry Mirra, Code Official, thanked the Borough residents for all they have done for AMVets, and the donations to be sent overseas to the servicemen.
AMVets Commander Charlie Dougherty presented an American Flag to the Mayor for the use of the Rutledge Girls’ Club.

Code Enforcement Report: Harry Mirra read his report for August 2012:

1 U&O Inspection- Failed
Non-Traffic Citations were reissued for bamboo and tree limbs on the front lawn.
A court date of 09/27/12 was set for the property maintenance violations at 7 Rutledge Ave.
25 President- Contractor was instructed to submit revised planes and move the port-a-potty from the front of the property.
4 Correction notices for grass in street along curb- 2 complied
1 Correction notice for bushes hanging over sidewalk

Took pictures of 2 houses with debris and asked the Solicitor for advice. Send a certified letter that gives the resident 30 days to comply. If the resident does not sign for the registered letter, the 30 days begin 3 days after the certified letter was sent.

Mayor’s Report: Mayor Kevin Cunningham read the Police report for August 2012. There were:

8/16  Stolen bicycle 100 block President Ave.
8/17  200 Block Linden Ave. sick raccoon in yard
8/19  Disorderly crowd at Triangle Park 12:38 AM
8/24  Suspicious persons 100 block Sylvan Ave.

Mayor Cunningham reminded residents to keep their houses and cars locked, and to call 911 for any suspicious people in the neighborhood.
Mayor Cunningham thanked the Fire Company and Police Department for all of the work they do.

4th of July: The Committee will meet on 09/16/12 at 221 Sylvan Ave. at 8:00 PM.

Rutledge Girls’ Club– There will be 4 games at the Triangle Park: 9/8 11:00 AM, 9/29 11 AM, 10/6 11:00 AM, 10/29 11:00 AM.

Communication: Marlaina Kloepfer reported that she has worked on information regarding the election to put on the Borough website. Other information added: work on newsletter, 125h anniversary, bamboo ordinance, welcome note from Mayor, meeting dates, safety tips.

The Delaware County Association of Boroughs is having a seminar on the new Borough Code on Tuesday, September 25, 2012, at the Brookhaven Borough Hall. A signup sheet was distributed.

Ordinance: Brian Costello reported that the ordinance committee is looking at revisions of the accessory use structure and deck ordinances.

Trash: Daniel Werner reported that he received a call from a resident whose recycling container was taken with the recycling.

Building: Brian Costello reported that revised plans were received for the construction at 17 President Ave., the fire damaged home. The homeowners at 25 President Ave. have hired a new contractor- new plans and an application must be submitted.

Highway: David Waltz reported that engineering fees for road repairs can be paid using loan funds. The price to repair a portion of Rutledge Ave. will cost approximately $18,000.00; it is not recommended.

New street signs will be put up.

The police asked that lines be painted on Morton & Swarthmore Aves. so that they can measure speeding.

Recreation: Marie Govannicci reported that Ed Mundy will submit a revised quote for the 7 sidewalk blocks at the Triangle Park.
Karl Eilinsfeld repaired the red sliding board that has a hole in it.

Sewer: Daniel Werner reported that he has had a positive reaction to his flier.

Shade Tree Commission: Nothing to report.

Public Safety: Tom Kopp reported the activities for the Morton-Rutledge Fire Co. for August.

There was a lightening strike in Morton on Cedar Ave.
There were severe weather notices from the County for Saturday, so a crew was kept at the firehouse in case of emergencies.
Tomorrow is the 11th anniversary of the September 11 tragedy. The American flag should be at half-mast.
The Horseshoe Tournament will be on Saturday, September 15.
Food was sold at the yard sale. Daniel Werner donated a refurbished bike; chances are being sold to win it.

Finance: The 2013 Budget will be discussed at the September 17 Committee Meeting.

Property/Borough Building: Diane McGauhey reported that the upstairs of the Community Center has been cleaned.
The new front door on the 1st floor will be installed this month.
A new recycling igloo was delivered.
Ms. McGaughey thanked David Waltz for having the tree and shrubs removed from the garage area.

Solicitor’s Report: Solicitor Guy Smith reported that the Ordinance for the Uniform Construction Code Appeals Board needs to be approved by Council.
Solicitor Smith reviewed the Sunshine Act. Council members are not allowed to deliberate by email or any other way except at an advertised meeting. Information can be passed on via email, but opinions cannot be voiced or asked for.

Old Business: Diane McGaughey reported that 98 homes participated in the Community Wide Yard Sale.
September is cleanup month in the Borough and residents are requested to clean up their properties.
Tom Kop reported that the new Emergency Operating Plan is in place and a resolution is needed to accept it. The matter was referred to the Solicitor.

New BusinessMOTION by Brian Costello, Second by David Waltz, to approve Ordinance #462,

Marlaina Kloepfer was appointed to the Board of the Delaware County Association of Boroughs.
There will be a meeting on September 2, 2012 at Brookhaven Borough Hall, to review the new Borough Code.
Ms. Kloepfer will attend the PA Association of Boroughs Fall Conference in State College, PA from 10/12-10/14/12 at a cost of $175.00.

Public Comment: Michael Maddren, Esq., prospective Solicitor, introduced himself to Council.

Bills for September 10, 2012:

MOTION by Brian Costello, Second by David Waltz, to approve payment of the bills for the month from the General Fund in the amount of $36,917.54. MOTION approved unanimously.

MOTION by Brian Costello, Second by Daniel Werner, to approve payment of the bills for the month from the Gas Fund in the amount of $3,029.05. MOTION approved unanimously.

MOTION by Brian Costello, Second by Daniel Werner, to approve payment of the bills for the month from the Sewer Fund in the amount of $1,665.50. MOTION approved unanimously.

MOTION by Brian Costello, Second by Daniel Werner, to go into Executive Session to discuss a personnel matter at 8:44PM. MOTION approved unanimously.

MOTION by Tom Kopp, Second by Brian Costello to end Executive Session at 9:39 PM. MOTION approved unanimously.

Since there was no further business, the meeting was adjourned at 9:41 PM.
